Contempt case relating to repatriation ITS in Honble HC of Delhi:

DOT came under scathing fire from Honble HC of Delhi for its blatant and deliberate violation of the Judgement of Honble High Court regarding repatriation of ITS. Honble HC severely reprimanded and came down heavily on the counsel appearing for DOT for its naked manipulations in implementing the judgement of HC.

Honble Court, short of passing a formal order for breach and contempt of its Judgement delivered by Honble High Court in March, 2012 regarding repatriation of ITS, came very close to terming the actions of DOT as amounting to contempt of Court. At one point of time, the Honble bench asked DOTs counsel to immediately and personally summon Secy/DOT to the Court to explain the conduct and actions of DOT in completely breaching implementation of the Judgement of the Court and persistently misleading the Court regarding its implementation.

However, after painstaking pleadings and explanation by DOTs counsel and his assurances to the Honble Court that necessary corrective actions would be initiated towards implementation of the judgement in letter and spirit, the matter was posted to 5th March, 2015. What is extremely important is that Honble High Court felt completely convinced and satisfied, after detailed arguments by counsel of SNEA(I), that DOT has perpetrated  clear breach of Judgement amounting to contempt. The stand of this Association towards ITS repatriation is undoubtedly getting vindicated.  


Promotion order of seventeen absorbed Additional GMs (NF) and Jt. GMs (NF) to the grade of  General Manager  (equivalent  to SAG) on regular basis - Congratulations to all promoted absorbed ITS officers.


ITS case at Hon Delhi High Court. The contempt petition filed jointly by SNEA(I), BSNLEU and AIBSNLEA against deployment of unabsorbed ITS officers in BSNL listed for hearing on 09.12.2013. The case is adjourned as the Hon Judge was on leave and there was no sitting. The next date of hearing is 19-03-2014.


Distribution of  SAG level  officers  in  Telecom  Operations  stream  in Territorial Circles and SSAs on provisional basis reg.

The suggestions given by the Association and UF to downgrade the SSAs based on the no of connections finally implemented. 14 SSAs downgraded from PGM to GM, 04 SSAs upgraded from TDM to GM, 49 SSAs downgraded from GM to TDM, 07 SSAs upgraded from TDE to TDM and 18 SSAs downgraded from TDM to TDE giving stress to revenue. SNEA(I) welcome the decision. The merger of small Circles and non recruiting units like QA, NCES/NCNGN, T&D, project and maintenance regions etc also to be implemented for effective untilization of the manpower.


Contempt of Court case on ITS issue in Hon High Court of Delhi:
The case filed by SNEA(I), BSNLEU and AIBSNLEA came up for hearing today. The respondent BSNL sought more time to file reply. DoT filed the reply two days back. Hon Court directed BSNL to file the reply within 4 weeks and posted the case for hearing on 09.12.2013.


Status of court Case on ITS deployment in BSNL

The case came for hearing in Hon Principle Bench CAT New Delhi in the OA. No. 1283/2013 today on ITS deployment in BSNL/MTNL. The respondents no 2 & 3, ie. BSNL and ITSA pleaded for more time to file the counter reply. The Hon Court given a last opportunity to the respondents to file the reply if any and posted for hearing on 18th Sept.2013. However, we are exploring the possibility of filling MA for early hearing.

Deployment of ITS officers of DoT in BSNL on BSNL posts — court case at Hon PCAT, New Delhi: The interim prayer for stay, in the OA filed by SNEA(I) & BSNLEU and AIBSNLEA against deployment of ITS officers from DoT to BSNL came up for hearing in the Hon PCAT today. Our advocate pleaded that DoT has violated earlier Hon PCAT Order dated 01.06.2011 filed by the absorbed officers as well as Hon High Court Delhi order dated 17.04.2012 for repatriation of unabsorbed ITS officers from BSNL/MTNL to DoT and deploy them in Govt service through surplus cell. Subsequently two applications for extension of time also dismissed on 18.05.2012 and 15.02.2013. The prayer made by the DoT in the Hon HC based on the cabinet decision dated 13.02.2013 “to repatriate the ITS officers and deploy them back in BSNL/MTNL” was also rejected by the Hon HC on 04.03.2013.   Even after that DoT issued order for deployment of ITS officers in BSNL/MTNL on 11.03.2013, the same prayer dismissed by the Hon HC on 04.03.13. In the WP 1803/2013 filed by us in the Hon HC against this order, Hon HC observed in the judgement that “ the order dated 11.03.2013 is in letter and spirit violates the order of Hon HC dated 15.02.2013” and directed us to approach the appropriate forum for relief, that is why we are here in the PCAT, our lawyer pleaded. Hon bench very much convinced on our arguments.

We strongly pleaded for the stay of operation of the order dated 11.03.2013 of DoT, deploying the unabsorbed officers in BSNL. Counsel for DoT and BSNL pleaded for some more time to file the counter reply. Sensing the game plan of DoT and BSNL to delay the case, our lawyer pressed for the interim relief to stay the operation of DoT/BSNL order dated 11.03.2013. Hon High Court after hearing the arguments from both sides decided to hear the case on merit immediately after the vacassion and posted case for hearing on 16.07.2013. A final decision is expected in three to four months from Hon PCAT.



Deployment of ITS officers in BSNL on BSNL posts: SNEA(I), BSNLEU and AIBSNLEA jointly filed petition in the PCAT, New Delhi praying “declare that the Impugned Order dated 11.03.2013, issued by DoT  tantamount to non-compliance of the Orders dated 17.04.2012, 15.02.2013 and 04.03.2013 passed by the Hon’ble High Court of Delhi in WP No. 22515/2005”.



Hon Delhi High Court judgment in writ petition 1803/2013 filed jointly by SNEA(I), BSNLEU and AIBSNLEA praying for quashing the order of DoT dated 11.3.2013 to deploy unabsorbed ITS to BSNL..........Hon bench clearly states that the impugned orders dated 11.3.2013 which both in letter and spirit violate the orders which are passed in W.P.(C) 22515/2005 and especially the order passed in CM No. 16683/2012 (our impleadment application).

The order of Hon HC is virtual indictment of the DoT and BSNL order dated 11.03.2013 and a clear endorsement of the prayer contained in our WP. Our stand thus stands fully vindicated. On the basis of this crucial order, we are filing original application in PCAT, New Delhi.

All the ITS officers repatriated to the Department of Telecommunications will be deemed to have joined DoT on repatriation before their deployment in BSNL. As such, these ITS officers are not required to physically report to the Department of Telecommunications on their repatriation.

Some salient features contained in the Cabinet decision on absorption of ITS Group “A” in BSNL/MTNL:

Comrades, as reported by us in the last CWC meeting at Chennai on 07th and 08th January, 2013, the Cabinet memo contains the following proposals:

a) Group “A” Absorption process in BSNL/MTNL stands concluded which in effect means that the seniority of the absorbed ITS is delinked from those who would, according to the note, continue on deputation for a fixed time frame. (This undoubtedly paves the way for promotion of absorbed ITS against BSNL posts as CGMs/GMs/DGMs etc).

b)  All the BSNL posts have to be filled up by absorbed officers to the extent absorbed officers are available on priority basis. (ITS who are to continue on deputation in BSNL/MTNL in accordance to terms and conditions of the Cabinet decision will not be eligible for consideration for promotions against BSNL posts hereinafter. That in essence means that absorbed and eligible JAG will get promotion to SAG and eligible SAG will get promotion as HAG, overriding seniority of those ITS who would be on deputation but are otherwise eligible for promotion in all respects).

c)  Govt fully empowers BSNL/MTNL to make recruitment to top Management posts which remain unfilled after promotion of eligible absorbed officers. This recruitment would be allowed under provisions of Rule 37which envisages that unabsorbed ITS would be also eligible to be recruited in BSNL/MTNL afresh after they get their pension and retirement benefits from Govt. for the service rendered by them in DOT. Their countdown for seniority in the respective cadres they are recruited in BSNL shall start ab-initio. They will be eligible for further promotions in BSNL.

d) BSNL/MTNL is allowed to retain the unabsorbed ITS officers on deputation (BSNL-941 and MTNL-83) for a maximum period of 10 years in a diminishing manner ie 10% will be repatriated/retired every year (Majority of repatriation on a year to year basis is from the DGM cadre and retirement from CGM/GM cadre). In MTNL, repatriation will be completed in 3 years time. However, these 941 & 83 unabsorbed ITS on deputation in BSNL/MTNL and about 400 repatriated officers would be eligible for promotion against only 65 posts at HAG/SAG level in DOT which is already filled up (Total DOT posts-463: Advisor / HAG-04, CGM / HAG-05, GM/SAG-56, DGM/JAG-100, STS-280, JTS-18). DOT will be conducting cadre review.

e) The deemed deputation period from 2005 also stands regularised.

Comrades, first three provisions cited above, except fourth one, and contained in the Cabinet decision address comprehensively our concerns in so far as our persistent and fundamental demand that BSNL should be led by a management belonging to the Company and posts of BSNL should be earmarked exclusively for absorbed people. These provisions have been included in the Cabinet decision because of strenuous and sustained efforts of the Association and the Joint Forum. Tireless efforts of the Association in the form of consistent and endless interactions with the bureaucracy in DOT and extensive and invaluable inputs that it gave to the concerned officers in DOT dealing with absorption process facilitated and enabled bureaucracy in DOT to include critical and significant provisions in the Cabinet note. The three provisions cited above and contained in the Cabinet decision is a landmark breakthrough as these three core provisions meet our critical concerns comprehensively and the concerns of the Company as well.

We have no words to congratulate our base level membership throughout the Country for their unstinted, unqualified and total support and huge patience that alone helped and enabled us to get these critical provisions included in the Cabinet decision to fully safeguard our career growth in BSNL as well as the growth of the Company. We also take this opportunity to assure our Comrades that whatever adverse provisions are contained in the Cabinet decision that affect us or growth of the Company in any manner would be fought tooth and nail legally. There would be absolutely no let up in our sustained fight to safeguard our legitimate interests and those of the Company.

This decision of the Cabinet dated 13.02.2013 finally lay to rest the issue of absorption of ITS in BSNL/MTNL. However, to know the finer and elaborate contents of the Cabinet decision, minutes of the Cabinet meeting are being awaited.





Congrats! Hon’ble High Court out rightly dismissed the plea of  BSNL management to allow ITS to continue on deputation in BSNL and directed BSNL Management / DOT to implement its order to repatriate unabsorbed ITS  within six weeks.Tireless efforts of our association along with AIBSNLEA and BSNLEU have borne fruit. Continue to have enormous faith in the mechanism of struggle. Comrades your tremendous support  and faith have given us strength to fight and we assure you that with your complete support we will fight out this issue to the last drop of our blood. Keep it up.


It is learnt that yesterday, Union Cabinet discussed the DOT proposal related to ITS absorption. Details of the Cabinet decision are awaited.


It is learnt that the Cabinet Note on absorption of Group-'A' ITS Officers in BSNL and MTNL submitted to the Union Cabinet by DOT on 23.01.2013 and supplementary note on 08.02.2013, which  is coming for consideration in Union Cabinet Meeting today evening at 17.30 Hrs.


Other important decisions taken by the Central Working Committee meeting of SNEA(I)  held at Chennai on 7th and 8th of Jan 2013.

CWC unanimously decided that the ongoing struggle on the issue of ITS repatriation and building a top management for BSNL should continue along with other Unions and Associations representing the Non Executives and Executives.Simultaneously the Association has to continue the legal fight against this issue.

Considering the undue delay in the resolution of recent LDCE related case, the CWC meeting unanimously decided that SNEA(I) has to implead in the LDCE case in the Hon. PCAT New Delhi to have an expeditious resolution of the case.

The CWC meeting reviewed the Court cases in which our association become a party like MT Case, BSNL MSRR case, Different cases related to seniority ( JTO seniority, 270 seniority case / 147 seniority case / 1966 reversion case), NCSC case, Illegal 3G roaming case, ITS repatriation case etc and also reviewed the huge expenditure incurred for the same. Considering the huge legal expenditure, the CWC unanimously decided to make separate Legal Fund and each member has to contribute Rs.200/- (Rupees Two hundred) towards this Legal fund.


Status on ITS repatriation case at Hon Delhi HC:

ASG submitted the minutes of the Committee of Secretaries final meeting held on 12-12-2012. ASG informed the bench that Cabinet is likely to take a final decision on this recommendation by the middle of January 2013.Hon.HC of Delhi extended the last date for implementation of its order to 01-02-2013. The matter is posted to 1st February  2013.

All CHQ / Circle / District / Branch office bearers are requested to co-ordinate with  the office bearers of other Unions / Associations and ensure 100% participation of employees in the DHARNA.The employees  who could not participate in yesterdays Dharna should participate in this historic struggle atleast today.

The case at Hon Delhi HC will be heard on 18.12.'12, today.


GS Com K. Sebastin alongwith Chairman and Convenor, Jt. Forum of BSNL & MTNL Unions/Associations and GS & FS /AIBSNLEA met concern DOT officers and enquired about the ITS repatriation issue and the status of reply to be filed in the Hon Delhi High Court. It is understood that the third meeting of Committee of Secretaries headed by the Cabinet Secretary and comprising of Secy(T), Secy(Pers), Secy(Expenditure), Secy(Pension and Pensioners Welfare) and Secy(Legal Affairs) was held in the last week to clear the cabinet note on ITS absorption issue and the minutes of the meeting are expected to be issued today from Cabinet Secretary and thereafter the Committee recommendations will be sent to Cabinet for consideration. The reply Affidavit will be submitted to Hon'ble High Court Delhi on this line based on the minutes. DOT is going to pray that Group-'A' officers presently working on deemed deputation in BSNL/MTNL may be permitted to continue to work in these organisations on a temporary and diminishing basis for a maximum period of 10 years in which they would be able to build their own cadre of officers through the process of recruitment and promotions.

We feel that as per Govt. decision allowing 10 years deputation of ITS in BSNL/MTNL will continue uncertainty which will adversely affect the viability of both the PSUs. We will strongly oppose such discrimination and dual stand of the Govt and BSNL Mgt.


We also met Director(Estt.), DoT and discussed for an early clearance of BSNL's proposal for the payment of 78.2% IDA fitment to BSNL employees and Govt. pension case of MTNL pensioners. Director(Estt) after some discussions on 78.2% IDA fitment case assured to clear it today itself. Accordingly, she cleared the case and sent to Jt. Secy(Admn) for further clearance. It is understood that the case will be sent to internal finance of DOT and thereafter to the competent authority for the approval to issue presidential directive.  Director(Estt.) mentioned that regarding pension fund in MTNL the matter is under consideration of DOT.

Meeting with Dr. Mrs. Kruparani Killi, Hon MOSC&IT on ITS issue. GS Com K. Sebastin, Convenor/Jt Forum Com V A N Namboodiri and other JF leaders met Dr. Mrs. Kruparani Killi, Hon MOSC & IT at her residence on 24.11.2012 and held discussions on relieving of ITS from BSNL & MTNL. Among MOS’s, she is holding the charge of both PSUs. JF leaders explained in detail the issue and impact of non resolution of this issue on the viability of BSNL & MTNL. We explained that the Managements proposal to continue with the non-optee ITS on deputation for another 10 years is no way going to help the revival of BSNL or MTNL and in that case BSNL & MTNL will collapse within few years. So like the non-optees, other employees of BSNL & MTNL also should be taken back to Govt service for their job and pension security. Hon MOSC&IT had a patient hearing for about 20 minutes and assured that the issue will be further discussed with Hon MOC&IT, Shri. Kapil Sibbal. JF leaders submitted a memorandum also.


Joint Forum of BSNL & MTNL Unions/Associations leaders met today at New Delhi and decided to intensify the ongoing agitation programme demanding immediate relieving of non-optee ITS, illegally continuing in BSNL & MTNL on deputation or to take all the BSNL & MTNL employees back to Govt Service. Detailed programme will be announced in the Jt Forum meetig scheduled to be held on 04.12.2012. All Circle/SSA/Branch Secreatries and other office bearers at different level should make intensive preparations for the implementation of the next programme.

GS, President, AGS(HQ) and GSs of all the major Unions/Associations attended the meeting. Dy GS represented NFTE(BSNL).

HISTORICAL PARLIAMENT MARCH BY BSNL & MTNL EMPLOYEES ON 22ND NOVEMBER'2012: Thousands of BSNL & MTNL employees marched to Parliament today at 12:00 Hrs from BSNL Corporate Office, New Delhi demanding immediate relieving of non-optee ITS, illegally continuing in BSNL & MTNL on deputation or to take all the BSNL & MTNL employees back to Govt Service.

Even after four chances to get absorbed in the PSUs BSNL & MTNL, the ITS officers numbering about 1,600 rejected BSNL&MTNL and opted to continue in government service whereas 4 lakh executives and non-executives got absorbed in BSNL & MTNL. By this, the top management enjoying both the benefits of government service such as pay and pension revision, job security and other financial benefit of the PSUs without any accountability. When the revenue is coming down every year due to lack of commitment, poor planning and execution, poor monitoring etc, they are presiding over the empire as CGMs and SSA Heads for years together without any change. At the same time the employees of BSNL/MTNL are deprived of their pay and pension revision due from 01.01.2007 in addition to other facilities. The non-optees (Govt employees) are getting promotions on BSNL/MTNL posts for the last 12 years where as the absorbed employees including the ITS Group A are denied their eligible promotions on BSNL/MTNL posts. Even today BSNL/MTNL Mgt not promoting the absorbed officers as CGMs/GMs/DGMs etc to protect the non-optees in BSNL/MTNL.

Comrades in huge number from far off places of Rajasthan, Haryana, UP(West), UP(East), Punjab Circles in addition to BSNL CO and Delhi Circles participated and made the March grand success. More than 1000 comrades from MTNL Delhi also joined the March to make it colourful. The Parliament March has become Historical with the huge participation of the employees.

The Parliament March was addressed by Hon'ble MPs Com. Basudev Acharya and Shri Arjun Ram Meghwal, all the General Secretaries in addition to the Convenor and Chairman, Jt Forum.Later JF leaders submitted the memorandum to Hon. Prime minister.

Meeting of Joint Forum of BSNL & MTNL Unions/Associations at New Delhi: Joint Forum of BSNL & MTNL Unions/Associations meeting held on 08.11.2012 and discussed about successful implementation of Parliament March at New Delhi and Rally at Mumbai on 22.11.2012.

Joint Forum decided to hold MASSIVE DEMONSTRATION at all other Circles/SSAs on 22.11.2012, the day of Parliament March.

Parliament March will start at 1200 Hrs from BSNL Corporate Office, Janpath New Delhi on 22.11.2012 and a Memorandum will be submitted to the Hon'ble Prime Minister of India.

All the comrades from nearby Circles like UP(W), Haryana, Punjab, Rajastan, UP(E), MP and employees from other Circles are requested to reach New Delhi on 22.11.2012 to participate in the Parliament March.

Live streaming of the Parliament March will also be available on all Union/Association websites.

To further intensify the agitation programme, Joint Forum leaders will hold meeting on 22.11.2012 itself.

Comrades, it is a Do or Die battle for the BSNL/MTNL employees wherein they have been betrayed by both BSNL/MTNL Management and Govt. of India by absorbing them in BSNL/MTNL and now allowing deputation of the non-optee ITS who disobeyed the Govt. of India's instructions, scuttled the absorption processes and enjoying the status of Govt. servants and benefit of BSNL/MTNL on deputation without owning the responsibilities of both the PSUs. All of them enjoyed one or two promotions on BSNL/MTNL posts from 2000 to 2012 even after continuing as Govt servant. DoT has now taken U-turn and sent a Cabinet Note for allowing ITS deputation in BSNL/MTNL for the next 10-years ignoring the Govt. instructions and Viability of BSNL/MTNL.

Against this blatant discrimination and dual stand, all BSNL/MTNL employees are on the path of agitation and they will continue to fight till the time they are taken back to Govt service or all the non-optees are relived to DOT.

All the comrades are requested to ensure their active participation in the ongoing agitation programmes.


Forum of BSNL Unions/Associations of UP(East) Circle met Smt Sonia Gandhi, Hon MP and UPA Chair person at Rae Bareli on 08.11.2012 and submitted memorandum regarding immediate end of Illegitimate deputation of non-optee ITS in BSNL/MTNL. Forum leaders explained the whole issue to her to understand the dangerous duality of ITS (Their lien in DOT and deputation in BSNL) which causing huge loss to BSNL, BSNL Services and customer's satisfaction. She has assured to look into the matter. She agreed that our demands are very genuine and immediately directed her PS Mr Dheeraj Srivastava to take up the matter with Hon MOC.


As per the Joint Forum of BSNL & MTNL Unions/Associations call, massive lunch hour demonstrations were held throughout the country on 08th Nov: 2012. At New Delhi more than 600 employees from BSNL & MTNL participated in the demonstration giving a clear message to CMD, BSNL & MTNL that they cannot shield the non-optee ITS hereafter. Those who are ready to become an integral part of the company only have the space in BSNL & MTNL and others have to leave. BSNL & MTNL Mgt’s decision to retain the ITS who opted for Govt service and want to remain in Govt service is not at all in the interest of the company as they are not at all concerned about the growth of the company. The non-optee ITS also demanding their relieving and then what makes CMD, BSNL & MTNL to keep them here as guests at the cost of the company? Can they run the company with these 1000 guests? Is it the intension of BSNL/MTNL Mgt to humiliate them further and send out? Is it their motive to further spoil the relation between the non-optee ITS and the employees?

If Mgt’s intension is to destroy this great company of ours, which is our bread and butter by non-relieving the non-optee ITS and continuing the uncertainty, comrades it is our duty to defeat this sinister move and protect our company, for our own survival.

The demonstration at New Delhi was addressed by GS & President/SNEA(I), Com VAN Namboodiri, Convenor/Jt Forum, Com P Abhimanyu, GS/BSNLEU, Com C Singh, GS/NFTE(BSNL), Com M. K. Bagchi, Chairman/Jt Forum, Com Prahlad Rai, GS/AIBSNLEA, Com Mudgil from MTNL EA, Com Kaushik, GS/TEAM and other GSs of Jt Forum.


Status on ITS repatriation case at Hon Delhi HC:

At the very outset, ASG, representing UOI, made submission before the Hon Bench that a proposal to repatriate unabsorbed ITS from BSNL/MTNL progressively within a time span of 10 years is under the consideration of Group of secretaries and that it will be very shortly sent to the Union Cabinet. On this submission of ASG, Hon Bench observed that "We are not concerned with what cabinet is to decide and the 10 year time period is absurd". Our Councel informed the Hon Bench that last time the plea of BSNL / MTNL to grant extension of 25 months was rejected by the Bench and this time they are asking time for 10 years. At this the Hon Bench observed “even now we will reject it”.

Counsel for the respondents (ITS) submitted that they have to be formally relieved from BSNL/MTNL immediately ending “deemed deputation” and thereafter they can be taken back to BSNL/MTNL on “deputation” which is legal. This was strongly opposed by our counsel quoting the DOP&T OM which strictly forbids such deputation. Hon Court also observed that this is nothing but continuation of the present situation, thereby putting an end the possibility of their entry through back door deputation.

Finally Hon Bench directed Counsel for UOI, BSNL/MTNL to relieve all unabsorbed ITS by 15th Dec failing which UOI should submit a detailed proposal. The case is posted for 18th Dec:’12.

Do incredible commitment, courage and high risk endurance capacity of Carl Fernandes Captain of the vessel MT Pratibha Cauvery hit by Cyclone Nilam in Mamallapuram on 31st October,12 convey anything to recalcitrant ITS Management obsessed with petty self interest of job security only?

MT Pratibha Cauvery was hit by Cyclone Nilam on the evening of 31st October,12 in Mamallapuram about 50 Kms south of Chennai. The vessel Captained by great Carl Fernandes with a crew of 37 started drifting and ran aground. Carl Fernandes made repeated and frantic calls to Indian Coast Guard, Indian Navy and other authorities to rescue the crew of the vessel, but, unfortunately, citing bad weather, no one could come to the rescue of the crew.


Finally, Captain, Carl Fernandes, almost certain that capsized ship would sink, decided to put 22 sailors on life boat to save their lives. What is remarkable and unbelievable is that Captain of the vessel almost sure of his death because vessel was badly capsized in deep waters did not abandon the vessel and desperately and courageously continued to steer the ship out of the whirlwind that it was caught in. The great courage, incredible selflessness and unwavering commitment of the Captain to save the ship somehow even at the cost of his life from getting sunk did not naturally go waste and yielded remarkable results when sudden change in weather conditions and untiring efforts of the Captain pushed the sinking ship to the safe shores. 

Compare this to the situation in BSNL. Captains of BSNL, having enjoyed journey on the ship when it was in very safe waters to the fullest possible extent, have since abandoned, what according to them is now sinking ship, BSNL, capsized in deep waters, and have already jumped to lifeboats (DOT) to ensure that they do not sink and die, leaving the crew (absorbed employees) in the lurch and high and dry in the sinking ship to die. These Captains of BSNL are caught in protecting their self interests of job security to such an extent that they have abandoned all efforts to steer the ship out of deep waters to safe shores and have no concern to save three lakh crew from getting sunk. From the safe shores, these Captains of BSNL, having since abandoned the ship to save their lives, are watching how the crew of the sinking ship, without real control and knowhow of how to steer the ship out of deep waters, are desperately and courageously trying their best to push the ship to safety. Do incredible courage, commitment and risk endurance of Carl Fernandes convey anything to any well meaning Captain of BSNL ?


Comrades, the continuation of non-optee ITS in BSNL/MTNL will be damaging and nobody is going to recognize them as our leaders or managers or bosses hereafter – as far as the employees are concerned they are outsiders, just foreigners. So far we treated them as guests, but it is high time for them to leave BSNL/MTNL if they don’t want to become an integral part of the company.
Mgt is concerned about the outsiders on deputation, not its employees or the company which is struggling.
They denied pay revision for its employees and even after assurance, trying to delay it (78.2%) but the outsiders are enjoying the pay revision since 01.10.2006.
Mgt continue to deny bonus, medical facilities etc to its employees.
Even for the pensioners who retired long back when BSNL was in profit, the pension revision not happened so far but for the outsiders pension revision is automatic.
These outsiders on deputation will enjoy the next pay and pension revision in 2016 also but what about the employees of BSNL/ MTNL?
If Mgt continued to protect them for cadre affinity against the interest of BSNL/MTNL, the employees will protect the companies by keeping them outside our premises.
So comrades, we have to intensify the non cooperation programme in the coming days.


Comrades, the ongoing case at Hon Delhi HC is having bearing on our agitation pragrammes to relieve the non-optee ITS as court didn’t given any extension of time beyond 30th Sept. The Hon Court asked UOI to submit the plan of action for redeploying the non-optees through surplus cell and it is nothing to do with their relieving from BSNL/MTNL to DOT. So the continuation of repatriated ITS in BSNL/MTNL is illegal and they should be relieved immediately.


Hundreds of employees participated in the Rajbhavan/ collectorate march held on 30th Oct and submitted memorandum to the Governor / Dist collector. Even small SSAs like Nashik(MH) more than 800 employees participated in the collectorate march, Jalandhar(PB) (600), Hoshiarpur(PB) (300) etc. More than 850 employees participated in the Rajabhavan March at Jaipur(RAJ), 800 employees at Patna(Bihar) etc. Rajbhavan March could not be held at Chandigargh, Banglore and Hyderabad due to law and order situation but the delegation submitted the memorandum. March will be held at Trivandrum on 02nd Nov due to Rashtrapathi visit on 30th Oct.

Decisions of the Joint Forum of BSNL & MTNL Unions / Associations held at New Delhi on 26.10.2012.

1.  In order to organise the joint movement, a joint committee by the name “Joint Forum of BSNL & MTNL Unions/Associations” is formed with Com. M. K. Bagchi as Chairman and Com. V.A.N. Namboodiri as  Convener. All the General Secretaries of the participant unions along with the Chairman and Convener will form the core committee for negotiation etc.

2.  Joint Demonstrations will be held on 8th November 2012 at Delhi and Mumbai and all centres in the country.

3.  The Parliament March decided by the Forum of BSNL Unions/Associations on 30th October 2012 at New Delhi will be postponed to enable the MTNL Unions/Associations to participate and the same will be organised by the Joint Forum of BSNL-MTNL Unions/Associations on 22nd November 2012, the day on which the Winter Session of the Parliament starts.

4.  A joint notice to Secretary DOT, CMD BSNL and CMD MTNL will be issued on the above programmes with the signatures of the Unions/Associations in BSNL and MTNL.

5.  The Hunger Strike for one week from 29th October and Non-cooperation from the same date as decided by the Forum of BSNL Unions/Associations will be organised by them.

6.  In the same way, the RajBhawan March and Collectorate March on 30th September 2012 will be organised as decided earlier.

7.  All efforts will be made to contact with the remaining Non-Executive unions in MTNL for a common programme.

8. Mode of Non co-operation agitation during the initial stage:

·    Non-cooperation with BSNL management in all respect.

·   Complete non-cooperation with the unabsorbed ITS continuing in BSNL on deputation.

·     Human chain to protect BSNL from the deputationists.

Agitation programmes and non-cooperation will be further intensified after MTNL unions joins the agitation.

Comrades, make all out preparations for the indefinite Non cooperation agitation and Day long hunger strike from 29th Oct to 03rd Nove. ’12... Arrange combined General body meetings and door to door campaign at Branch/SSA level and at all major stations/Exchanges.

Parliament /Raj Bhavan/ Collectorate March Postponed from 26th October to 30th October ’2012 due to Eid Festival: An emergency meeting of the Forum of BSNL Unions/Associations was held on 18th October 2012 at New Delhi to review the progress of different trade union programmes, Hunger strike from 29th to 03rd November’12 and indefinite Non-cooperation from 29th Oct’12. Com. C.Singh, GS, NFTE presided. Com. V.A.N.Namboodiri, Convener, reported the activities after the last meeting and about the implementation of the programmes chalked out by the Forum in connection with the relieving of non-optee ITS. GS and AHS(HQ) attended the meeting.

After detailed discussions the following decisions were taken:

1.       It was decided to postpone the Parliament / Raj Bhawan/ Collectorate March to 30th October 2012 since 26th October happens to be a holiday in some Circles and for better mobilisation. The Memorandum to be submitted to the Prime Minister with copy to the Governor, Collector etc. will be prepared and put in the websites.

2.       The Hunger Strike and Non-cooperation will start on 29th October as decided earlier.

2.  Forum leaders will approach MTNL Unions/Associations for a joint programme. Convener and other General Secretaries will consult with MTNL leaders for the same.Now it is decided that BSNL and MTNL Unions/Associations representatives will meet on 25.10.2012 at 15.00 Hrs to discuss and decide the common agitation programmes on ITS issue for the future.

3.  The Forum called upon to conduct Branch / District / Circle joint meetings of all Unions/Associations and at other major exchanges and plan for effective implantation the agitational programme. All the CHQ Office bearers, Circle/Branch Secretaries are requested to ensure for successful implementation of agitation programmes.


Mass Dharna demanding immediate reliveing of non-optee ITS from BSNL. As per the initial reports received by CHQ, thousands of employees participated in today’s Mass Dharna throughout the country. Some SSAs even reported 90% to 100% participation. AS, NE I, NE II, OR, RAJ, MH, KTK, BR, PB, TN, MP, J&K, AP, UP(E) Circles reported massive participation in the Dharna since morning. KRL and WB Circles holding the Dharna on a later date due to festivals. At BSNLCO comrades from neighbouring Circles like HR and UP(W) also participated.

Entire BSNL employees are agitated over the discrimination and biased treatment given to the absorbed employees by the non-optee ITS dominated BSNL Management. The employees come out of the office and joined the Dharna demanding “BSNL Mgt should not protect the non-optee ITS at the cost of BSNL”. When company is sinking, BSNL Mgt is working on a single agenda “how to protect non-optee ITS”. They are least bothered about the company or the fate of 2.75 lakh families.

Comrades, get ready for the indefinite non-cooperation movement from 29th Oct:’12 to liberate BSNL from the clutches of non-optees (who never want to join BSNL, shoulder responsibility and take risk for the company but to enjoy everything) and the Mgt protecting them.




Massive protest demonstrations held throughout the Country demanding immediate relieving of non-optee ITS continuing in BSNL. As per the initial report, thousands of employees participated in the demonstration protesting against the discrimination and double standard adopted by the CMD, BSNL and Mgt. The massive participation is a clear message to BSNL Mgt --- either relieve the non-optees or take action to take back all the employees(absorbed/recruited) back to Govt service and allow to work in BSNL on deputation as in the case of non-optee ITS. Further if BSNL Mgt feels that without ITS BSNL could not be run, then they should have completed ITS Group “A” absorption first before the absorption of Group B, C & D.

Hon Delhi High Court order dated 01.10.2012 on the application filed by BSNL/MTNL for extension of time – Hon HC directed “The learned council for Union of India shall take instructions with regard to the surplus manpower that they have and how they will redeploy them on account of the option exercised by the persons working with BSNL/MTNL”. CM 16683/2012, application file by SNEA(I), BSNLEU and AIBSNLEA also re-notified for the next date, 31.10.2012.

Forum of BSNL Unions and Associations met today at New Delhi and unanimously taken some historic decisions with respect to relieving of non-optee ITS from BSNL. Meeting attended by all the Unions/Associations in BSNL including BSNLEU, NFTE(BSNL), SNEA(I), AIBSNLEA, AIGETOA, FNTO etc. Forum decided to launch trade union programes till all the deputationists are relived from BSNL. Detailed programme will be updated tomorrow.





 Tentative programmes are as below:

 11th to 13th October : Savingram campaign to Hon PM, Hon MOC

                                   & IT, Cabinet Secretary, Secretary /  

                                  DOT and CMD/BSNL and demonstration on 

                                  11th October, 2012..

 15th October           : One day Dharna at BSNLHQ/Circle HQ /

                                  SSA HQ.

 26th October           : Parliament March at Delhi, Raj Bhavan

                                  March etc.


29th October onwards: Indefinite Non Cooperation Agitation  and

If the non-optees are not relieved by that time, Forum decided to go for INDEFINITE STRIKE and exact date will be announced later.

 Meanwhile efforts are going on to have joint agitation   with MTNL also.

Now it is up to CMD and BSNL Management to decide whether they have to run BSNL services with the 2.75 lakhs BSNL employees or with the 1000 depuatationists/Foreigners (non-optee ITS). They have to decide whether they are with the BSNL Employees or with the Non-optee ITS.


Decision of Govt. taken in 2001 on absorption of ITS Group “A” in BSNL defeated through meticulously calibrated conspiracy of non-optee ITS and BSNL Management controlled by them. Govt. completely loses its face by peevishly succumbing to utterly contemptuous and persistent defiance of Govt’s decision by deciding to allow ITS to continue on perpetual deputation in BSNL ........... View GS’s letter addressed to Hon. Prime minister.     


Updates on ITS issue:  BSNL management has filed an application in the Hon'ble High Court of Delhi "Grant sufficient time and flexibility to Respondent No.4 i.e. BSNL to revert/relieve the Petitioners (non-optee ITS Officers) back to their parent department i.e. DoT in a phased manner”. BSNL in its application narrated that it started MT and DGM recruitment process and it will take another 10 to 15 years to have a officers at top level. In this manner BSNL management is ensuring continuation of deputationist ITS officers in BSNL / MTNL till their retirement. Last time BSNL pleaded for 25 months extension, but this time BSNL is pleading for indefinite period.

DOT administration due to pressure from CMD, BSNL/MTNL and ITSA sent a Cabinet Note to the secretaries of nodal ministries for clearance and thereafter to cabinet for approval to allow continuation of deputation of ITS officers in BSNL / MTNL. To contest against this SNEA(I), BSNLEU and AIBSNLEA has filed  intervention application in the Hon'ble High Court of Delhi. The case is expected to come up for hearing in the next week.


Repatriation of unabsorbed ITS officers back to DOT as per the Hon Delhi High Court Judgment:

Massive Demonstrations held throughout the country in protest against the BSNL Managements delaying tactics in implementing the Hon Delhi HC order for relieving of unabsorbed ITS officers latest by 30th Sept and the move to retain them through backdoor in the name of operational requirements.

The massive participation of employees in the demonstrations is a clear message to BSNL Management that they will not tolerate any move to retain the unabsorbed officers in BSNL.

Forum of  BSNL  Unions  and  Associations  serves notice to the CMD  BSNL regarding Lunch hour demonstration on 18-09-12 in respect of ITS repatriation issue.


Forum of  BSNL  Unions  and  Associations  writes to  CMD  BSNL regarding the implementation of 12th June agreement.


President/SNEA(I), G.L.Jogi, Com V.A.N.Namboodiri and Com Abhimanyu of BSNLEU, Com Chandeshwar Singh of NFTE and Com Venugopal and Com Prahlad Rai of AIBSNL EA met Jt/Secy(T)/DOT, Sh. Mallay Srivastava, dealing with issue of ITS absorption, and had a very detailed discussion on latest developments relating to ITS absorption issue.

Representatives of the United Forum explained in detail the dangerous consequences that any kind of loose/hotchpotch arrangement like deemed deputation/deputation/foreign service of ITS in BSNL will have on future viability and growth of the Company and in very clear terms conveyed to him that any such move will have very formidable resistance from absorbed/recruited personnel of BSNL who have a fundamental and unquestionable stake in BSNL, in addition to further inflicting irreversible and irreparable damage on the viability of BSNL. Jt Secy(T) was also reminded of the fact that DOT has a obligation to adhere to the decision of the Govt. on absorption issue as well as directions of Hon’ble High Court of Delhi.

Jt Secy(T) was frank enough to mention that various possibilities to end the stalemate and help the issue reach finality are being weighed by DOT in consultation with other nodal ministries like D.O.E., D.O.P.& Trg, Law ministry etc. and that so far no definite view is crystallized.  Jt Secy(T) was quite emphatic in mentioning that DOT will leave no stone unturned this time to ensure that issue attains finality and does not continue to linger on as it has been for about a decade. He further mentioned that important and detailed inputs given by Associations in the meeting with Secy/DOT on 3rd Sept were being given serious and objective consideration.

Forum of BSNL Unions and Associations unanimously decided to hold lunch hour demonstrations throughout the Country on 18th Sept.,12 at BSNL Hqs/ CGMHqs/ SSAHqs to protest against deliberate inaction and failure of BSNL management to take any initiative to complete the process of repatriation of unabsorbed ITS by 30th Sept.,12 in compliance to the directions of Hon’ble High Court of Delhi. The protest also signals a clear warning to DOT that any attempt to allow ITS to continue on deputation/deemed deputation/foreign service etc. in BSNL would be fought tooth and nail by absorbed/recruited executives/non executives of BSNL since such an loose arrangement to appease ITS would be last nail in the coffin of BSNL.  United forum also unanimously decided to fight the issue legally and intensify organizational activities by launching harder organizational actions in the days to come in case DOT decides to go ahead with deemed deputation/foreign service of ITS in BSNL.           

General Secretary SNEA(I) could not attend the meeting since he is at SriNagar attending the Circle conference of J&K.     


Meeting with Secretary, DOT on ITS repatriation issue.

Secretary, DOT called SNEA(I) & AIBSNLEA representatives for a meeting to ascertain views of both Associations on ITS repatriation issue. SNEA(I) was represented by GS Com K. Sebastin and President Com G. L. Jogi whereas AIBSNL EA was represented by its GS, AGS and President. The official side, besides Secy/DOT, was represented by   Addl Secy/DOT, USO Fund Administrator, Member (S), Member (T), Jt. Secy (T) and Jt. Secy (A).

We explained in detail to Secy/DOT how non resolution of this vital issue has adversely impacted the growth of BSNL and impeded its revival. Unless top management of the Company becomes an integral part of the Company and has a direct stake in the company, revival of BSNL is impossible, we explained. The core issue for revival of BSNL is that it must be led by management belonging to the Company. No Company working in present competitive environment can survive and thrive unless it is led by those who belong to the Company. Seen in this context, building a management structure for BSNL, which is part and parcel of the Company, is fundamental and critical to the revival and growth of BSNL, we emphasised. Any other mechanism like bringing ITS on deputation/deemed deputation/Foreign service employed would be counterproductive and unacceptable, we maintained.

 We underlined that absorbed officers/executives are competent enough to maintain the services consequent upon repatriation of unabsorbed ITS Group A officers. When Secy/DOT said that senior officers are needed  for planning, policy and manning strategic positions in the Company, we explained that sufficient absorbed SAG level officers are already available and eligible for promotion to HAG and they can be posted on key and strategic positions as heads of Circles. In JAG level, large numbers of qualified and experienced executives are available and they can be easily utilized to head smaller SSAs. In case of SAG level officers, if BSNL feels some officers are required, they can be recruited at a later stage through outside recruitment, we mentioned.

We categorically impressed on Secy/DOT that any move to recruit officers from outside market should be initiated only after conclusion of process of repatriation, otherwise they will sabotage the recruitment   process as was done in the case of absorption in 2005, 2008, 2011 and 2012. Further, there cannot be different set of rules in the same CPSU since that would be discriminatory. We presented a detailed and comprehensive note on how the issue can be addressed, without affecting operations and growth of BSNL, based on the actual field requirements. We mentioned that BSNL management should assess and project its requirement in an objective manner. Secy/DOT was categorically assured by us that in the event of challenging situation we are fully capable of maintaining flawless services and DOT should fully rest assured on this account and have no apprehensions.   

Secy/DOT said that Government will not take any extreme position on this issue and is going to take a very balanced decision on this issue very shortly according highest priority to viability and growth of BSNL.

We requested Secy/DOT to pursue the issue of pension contribution by BSNL on actual basic instead of on maximum. Secy/DOT stated that the issue has been taken afresh with D.O.E and will be pursued further.

Finally, we thanked Secy/DOT for giving us an opportunity to give our feedback and opinion on vital issue of ITS absorption.

Issue related to Absorption/Repatriation of ITS officers --  BSNLCO sought the List of ITS Group A officers working in BSNL as on 01.10.2000 along with Grade/Designation (substantive).



Corporate office has issued instructions to keep the order of extending  Sixth CPC allowances to Gr A officers on deemed deputation in BSNL under abeyance. View Order Copy.

There is no change in our agitation programme. As decided by the Forum of BSNL Unions and Associations all office bearers and activists are requested to intensify the Dharna programme on 06-06-2012 and make it a grand success.


Hon'ble High Court Kerla at Ernakulam  interim order on 147 SDEs (LDCE Quota) case:

Hon'ble Kerala High Court in its interim order dated 28.05.2012 on 147 SDEs seniority case, vacated the stay on promotions granted on 23.02.2012. It has paved the way for promotion from SDE to DE and DE to DGM. Hon. High Court of Kerala not extended the stay on the judgement of Hon. CAT Ernakulam quashing their seniority. Earlier stay on CAT judgment was modified on 23.02.2012 as stay on promotion which is vacated on 28.05.12.

BSNL management lands Company (BSNL) in bankruptcy for the first time- brings Company under market liability and debt by taking a loan of Rs. 1383.8 crores from market (Union Bank of India). CMD and board of directors are squarely responsible for this deadly situation by not addressing and resolving critical issue of absorption of ITS. View CMD's Letter to ITS Officers


Dispassionate appeal to ITS fraternity -neither a sermon nor warning.  

Every organization passes through a period of crisis - mild, grave or deadly. BSNL is passing through a deadly crisis which everyone in BSNL, including our ITS friends, recognize and acknowledge. This great Organization with unparalleled strategic importance in the telecom sector and huge commitments towards country and society at large has given everyone in BSNL its best in terms of career growth, status in society, and, above all, great satisfaction of immensely contributing towards building massive and wide spread telecom infrastructure in the country which, in turn, has gone a long long way in development of other key and basic infrastructure that has eventually contributed towards huge economic growth and upliftment of the downtrodden.


By any stretch of imagination, BSNL cannot be compared to any private telecom Company. Objectives and commitments of BSNL and private sector are 180 degrees apart.


Today, when BSNL is in deep waters, it is incumbent upon all of us, more so on ITS, as frontline leaders of the Company, to get involved in the task of revival of the Company with unparalleled, absolute and single minded commitment, leaving everything else to the backburner.


In this context, it is extremely vital for ITS to get into the mainstream of the Company quickly and lead it from the front to rebuild the Company which is in dire straits.


What an incredible and everlasting satisfaction they will have of facing this great challenge of rebuilding a company which has been their birthplace and bread and butter successfully, even if it means a little less money which is also not really true. They will go to their homes after retirement with greatest ever satisfaction of facing the formidable challenge of rebuilding a company which is a national asset. They will enjoy to the hilt every bit of the effort they would have put in the process of revival, and these memories they will relish and carry with them till they breathe their last. They will always feel elated and on the top of the world whenever they will recall great challenge they willingly embraced and successfully accomplished, assuming it is true they sacrificed a little bit of money.


They will also have greatest of great satisfactions of protecting the families of about 3 lakh telecom employees. Safeguarding the future of the families of these 3 lakh employees and securing them from coming on to the streets will give virtually them everything in the world.   


Compare this to the painful situation where they (ITS) continue stretching the thread (the way they are doing it now) till it breaks. So long as the thread does not break it is great but once it breaks both the hands fall in gloom and nothing remains. The company will not remain, we will also possibly not remain, but ITS would be greatest dejected lot.


Instead of embracing great challenge (great challenges do not come very often) of rebuilding telecom enterprise that has been their place of pride, and thus fulfilling their career dreams, they would be wasting their talent and energy working somewhere in transport / fertilizer / textile sector. May be they get a little more money when they go home, but they will be totally disillusioned and disappointed at the end of the day. They would be biting their nails in defeat, despair and desperation for not having added value to and rescued an Organization that was their home and hearth.


 At the back of their mind till they go to the grave they will be thoroughly disenchanted, regretful and will always have a feeling of guilt of being selfish and rank opportunistic by allowing their birthplace to crumble just for the sake of little money. Let them not go to the grave in a fully remorse state. Defeatism and dejection will stare at them till they live and that would be really agonizing for any sensitive and rational person, having had some affinity towards his home.


Finally don’t blackmail your home and family, don’t hold your home and family to ransom and don’t mortgage your home by exploiting the situation and taking advantage of it. That is the worst of all rather highly despicable and abominable that human personality least of all elite class ( ITS says it belongs to that category) can ever think of doing.


Don’t stretch the thread to an extent where it breaks for consequences of such stretching would be deadly since that stage no one can control fury, wrath and anguish of masses, which is slowly but surely brewing and accumulating, from exploding and unleashing like a volcano. Don’t create conditions of civil war and total instability by arm twisting and blackmail. Don
